Order On order of the Court, the motion for immediate consideration is considered, and it is GRANTED. The application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the order of the Court of Appeals dated April 1, 1994, which denied defendant's motion to remand. We REMAND this case to the Court of Appeals with the direction that it remand the case to the Oakland Circuit Court to allow the defendant to file a motion for new trial. Since the defendant's appeal of right was filed in the Court of Appeals on August 6, 1992, and is apparently close to decision, the Court of Appeals may, at its option, defer remanding the case to the Oakland Circuit Court until it issues its opinion on the merits. If the Court of Appeals takes that option, the remand shall be treated as if under MCR 7.302(C)(4) for purposes of any subsequent proceedings. The motion for peremptory reversal is DENIED as moot. We do not retain jurisdiction.
